Legal Basis
The concept of “Information Society Services” originates from Article 1524 of the Turkish Commercial Code No. 6102 and the “Regulation on the Websites to be Established by Capital Companies”. The website and MERSIS-based publication obligation under that Code applies ONLY to capital companies subject to independent audit; a 2013 amendment removed the obligation for capital companies outside the independent-audit scope. In addition, identity and contact disclosure duties that bind every e-commerce service provider regardless of audit status arise from the Electronic Commerce Law No. 6563 (Art. 3) and its Regulation, the Consumer Protection Law No. 6502 and the Distance Sales Contracts Regulation, and the ETBIS registration/disclosure rules.
